Introduction
This Privacy Policy is intended to provide you with a clear overview of the ways in which We collect, use and share the personal data you have provided when using Our Sites and Services and implements the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the free movement of such data and repealing Directive 95/46/EC (hereinafter RODO).
General provisions, scope of data processing
- This privacy policy applies to the website operating at: https://optitrans.pl/ (hereinafter referred to as the Service). The administrator of the personal data, within the meaning of Article 4, point 7 of RODO, processed on the Website: https://optitrans.pl/ is Optitrans Sp. z o.o. headquartered: ul. Wincentego Witosa 2, 87-800 Włocławek , hereinafter: ,,Administrator” or ,,Company”. Contact with the Administrator is possible at tel. 881 222 888, e-mail: biuro@optitrans.pl
- When using the u website, Users are able to provide the Administrator with personally identifiable information:
- Users may, through the use of the contact options made available on the website in the “Contact” section (e-mail address, contact number), provide us with personal data which makes it possible to identify them (for example: name of the company, form of activity, registered office address, other addresses related to the conducted activity, identification number such as NIP, REGON, KRS, data of representatives and persons appointed to contact and perform the contract; names, surnames, e-mail addresses, telephone numbers; and all data, including financial data, necessary to perform specific services);
- The website uses cookies, which also collect certain data about the User in order to ensure the smooth functioning of the website, as well as for marketing and statistical purposes, see “Cookies” for more information.
Purposes and basis and principles of personal data processing
In connection with the Website: https://optitrans.pl/, the Administrator will process personal data in order to respond to an enquiry sent by e-mail, to conduct a telephone interview, as well as for the purposes detailed under “Cookies”.
The legal basis for processing personal data in these cases is:
- Your consent expressed, e.g. by accepting the cookies used more than necessary or by providing us with additional contact details, other data and information on your initiative (Art. 6(1)(a) RODO);
- the necessity to take action at the User’s request before entering into a contract (Article 6(1)(b) RODO) and the legitimate interest pursued by the data controller (Article 6(1)(f) RODO) in order to respond to an enquiry sent via any communication channel (e.g. email, telephone), including in particular in relation to interest in our services;
- the contract binding us – Article 6(1)(b) of the RODO;
- the need to comply with our legal obligations (legal basis Article 6(1)(c) RODO), also with regard to the conduct of correspondence in connection with our tasks;
- legitimate interest pursued by the controller, such as answering a question or question or direct marketing, the use of cookies to maintain the proper functioning of the website, and the repudiation of civil law claims (Article 6(1)(f) of the DPA).
Provision of contact data in the email sent/phone contact is voluntary, however, failure to provide such data may prevent the Administrator from responding to the enquiry sent by the User.
Provision of the data is obligatory when their processing is based on legal provisions. Failure to provide such data may result in the impossibility to fulfil the obligations incumbent on the Administrator

- The controller shall take particular care to protect the interests of data subjects, in particular, he shall ensure that the data he collects are:
- processed lawfully, fairly and in a manner transparent to the data subject,
- collected for specified, explicit and legitimate purposes and not further processed in a way incompatible with those purposes,
- adequate, relevant and limited to what is necessary for the purposes for which they are processed,
- correct and updated as necessary,
- kept in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the data are processed,
- processed in a manner that ensures adequate security of personal data, including protection against unauthorised or unlawful processing, accidental loss, destruction or damage.
Eligibility, recipients of data, duration of processing and transfers to third countries
- Pursuant to the provisions of the RODO, the person whose personal data is processed by the Controller has the following rights:
- The right to access your personal data and to obtain from the Controller confirmation as to whether or not personal data is being processed and, if so, to obtain access to it and to provide information to the extent indicated in Article 15 RODO;
- in the case of processing on the basis of consent, the right to withdraw it at any time, whereby the withdrawal of consent to processing will not affect the lawfulness of the processing carried out before its withdrawal;
- the right to request the rectification of his/her personal data which is inaccurate, the completion of incomplete personal data;
- The right to request the erasure of your data – in the cases indicated in Article 17 of the RODO;
- The right to restrict the processing of your personal data – in the cases indicated in Article 18 of the RODO, including questioning the accuracy of your personal data;
- the right to object to the processing of personal data where the processing is based on a legitimate interest of the controller, including in particular the use of direct marketing;
- the right to lodge a complaint with the supervisory authority in charge of personal data protection, the President of the Office for Personal Data Protection, in the event that the processing of personal data is considered to be in breach of data protection regulations.
- Personal data may be transferred:
- entities authorised under generally applicable legislation,
- entities processing personal data on behalf of the Administrator, among others, providers of hosting services (e.g. email domain hosting, cloud services hosting) and other processors – whereby such entities process data on the basis of a contract with the Administrator and only in accordance with the Administrator’s instructions.
- Your personal data will be stored for the period necessary to fulfil the purposes, possibly including the period of the statute of limitations for claims or until your consent is withdrawn, if this is the basis for data processing. Personal data processed on the basis of concluded contracts, in order to comply with a legal obligation incumbent on the controller, will be processed for the period resulting from separate legal provisions.
- As a rule, we do not transfer data to third countries. However, we would like to inform you that we have a fanpage on the social network Facebook. The data on FB servers are processed in third countries, including the USA, as described in the privacy policy of this website. More information on this and links to the relevant privacy policies can be found under , “Social media profiles”.
- Our website contains a plug-in for the social network Facebook (Meta), on which we have set up a fanpage, and for LinkedIn. We would like to inform you that if you click on the plug-in for a particular service, your data, e.g. your IP address and browser ID, may be passed on to the respective service’s data administrator (especially if you are logged in to these services), in accordance with their privacy policies. Please refer to the privacy policy of the respective service for more details.
- The Facebook social media platform is provided by Meta Platforms, Inc, registered office address 1 Hacker WayMenlo Park, California 94025, which in Europe operates through Meta Platforms Ireland Limited. Information on data processing on the Facebook platform is available at https://www.facebook.com/privacy/policy.
- The Linkedin service is provided by LinkedIn Corporation, headquartered at 1000 W Maude , Sunnyvale, CA 94085, US, part of the Microsoft group. Information about the service’s processing of personal data is available at LinkedIn’s Privacy Policy.

Cookies
- On the https://optitrans.pl/ website, the Administrator uses cookies to adapt the content on the website to the needs of the User, to improve the operation of the website and to analyse website traffic. Cookies (so-called “cookies”) constitute IT data, they are text files which are stored on the User’s terminal equipment and are intended for the use of websites. Cookies contain, inter alia, data such as the name of the website from which they originate, the length of time they are stored on the User’s terminal equipment and a unique number which was generated in order to identify the web browser used by the User to connect to the website. Cookies often store information that is necessary for the website to function properly. Cookies may also store a unique number that identifies the User’s terminal device.
- Cookies used on the websites may be used for the following purposes:
- to ensure the correct operation of selected website functions,
- user session handling,
- to ensure an even load on the servers,
- to collect anonymous statistics so that the Administrator can better understand user expectations and develop the website to make it even more user-friendly,
- optimising the website (i.e. adapting its appearance to the most popular devices),
- advertising,
- to prevent the same user from repeatedly being presented with a message informing them of the website’s use of cookies.
- If the User does not agree to the Administrator’s use of cookies or wishes to limit the extent of the use of cookies, he/she can opt out of the website, change his/her browser settings or use the tool to change the cookie settings on the website.
- The user may at any time change the settings of his or her browser with regard to cookies, in particular block the automatic handling of cookies (in whole or in part).
- The administrator informs that restricting or disabling the use of cookies may affect some of the website’s functionalities.
- The data collected is used to monitor and see how users are using our website in order to improve the site, providing a more efficient and seamless navigation experience. We monitor user information using the Google Analytics tool, which records user behaviour on the site.

Social media profiles
- As part of our marketing activities, we maintain a profile on Facebook, under the name:

- It is the responsibility of Optitrans Sp. z o.o. with its registered office at 2 Wincentego Witosa Street, 87-800 Włocławek.
- The Facebook social platform is provided by Meta Platforms, Inc, registered office address 1 Hacker WayMenlo Park, California 94025, which in Europe operates through Meta Platforms Ireland Limited. Its data processing policies can be found at the link https://www.facebook.com/policy.php/.
- Please note that the Company is not responsible for the processing of personal data of Fanpage users by the Facebook Administrator, including in particular personal data posted on Users’ profiles. The Company does not have access to this information, nevertheless, by operating the FB Fanpage, it is, together with Meta Platforms, a joint data controller and is responsible for this personal data that has been posted on the Company’s Fanpage or sent to us in connection with its operation.
- Using our FB profile, you can also get in touch with us via the integrated Messenger app provided by Meta.
- We ensure that the operation of our fanpage complies with the requirements that are contained in the FB regulations. Through the operation of our fanpage we collect and process the following personal data:
- an identifier of the portal user (usually including first name and surname or nickname);
- profile picture (which in some cases allows us to get to know the User’s image);
- other images (which may also depict an image) resulting from the fanpage-user relationship that we receive as a result of your activities on our profiles. The provision of these images to us is entirely voluntary;
- the content of the comments and the content of the conversation carried out via the Tyl Messenger application (in these conversations, Users may provide us with their e-mail address, telephone number, we also receive a description that the User includes in relation to the circumstances of our correspondence).
- Personal data collected through communication with Users is only processed for the purpose of responding, if necessary. User activity related to the use of our fanpage will not be archived outside of FB , unless it is necessary for evidentiary purposes or a contract is concluded.
- The processing of personal data on our fanpage is carried out on the following legal bases:
- Article 6(1)(a) of the RODO i.e. based on the consent that the User gives by submitting a profile request to us;
- Article 6(1)(b) of the DPA, i.e. in connection with your interest in our products and services – your wish to conclude a contract with us;
- Article 6(1)(f) RODO based on our legitimate interest, which may be, for example, the assertion of claims.
- The information we hold about Users in messages will be stored for the period necessary to answer the questions asked or until the termination of the cooperation, if this occurs, including cases concerning the assertion of possible claims. In the case of the information we hold within the comments provided by the User, it will be available on our site until it is deleted by the author or administrator. The personal data collected by Meta, i.e. history of posts, history of activity in the Messenger application, is subject to retention under the terms of the regulations of the respective portals.
- Under the terms of the RODO, each User of the fanpage has the following rights in respect of personal data:
- The right of access to the content of your data,
- the right to obtain a copy (if available),
- the right to rectification,
- the right to erasure,
- the right to restrict processing,
- the right to object to processing,
- The right to portability (if there is an adequate basis and opportunity),
- The right to lodge a complaint with the President of the Data Protection Authority in the event that we are found to be in breach of data protection legislation,
- the right to withdraw consent to processing, if it was the basis for the processing, where the withdrawal of consent does not affect the lawfulness of the processing carried out prior to its withdrawal.
- The establishment of any relationship between the administrator of the profile and the user of the social network is entirely voluntary.
- The transfer of data to the US is currently taking place on the basis of a new transfer programme, the Data Privacy Framework.
Final provisions
- Optitrans Sp. z o.o., as the Administrator of your personal data, makes every effort to ensure that the physical, technical and organisational measures in place ensure the protection of your personal data against accidental or wilful destruction, accidental loss, alteration, unauthorised disclosure, use or access in accordance with all applicable legislation, including in particular the RODO Regulation.
